TPG was engaged by Woolworths Limited to prepare a Development Application for the development of a Woolworths supermarket and specialty shops for South Schofields, containing a new car park, full-line supermarket, a liquor shop and two specialty stores. TPG’s key responsibilities included due diligence and design input to address challenges associated with the existing site to ensure the quality design of a supermarket and retail anchor for the Schofields locality. TPG’s other responsibilities included the preparation of a Statement of Environmental Effects (SEE) and liaison with Council and Joint Regional Planning Panel (JRPP) through the approval process as well as expert evidence for subsequent Land and Environment Court proceedings.
TPG was engaged by Woolworths to appeal the decision of Council to refuse to the NSW Land and Environment Court. A Section 34 Conference was agreed to by Blacktown Council and the applicant to reach an agreement as to the terms of the decision and the DA was approved by the NSW Land and Environment Court on 9 February 2012. TPG’s key responsibilities during this process were to provide continual liaison with the client’s instructing solicitors, to review Council’s files in relation to the subject site for previous approvals, to prepare a preliminary expert town planning report, to prepare and sign the Statement of Facts and Contentions for the purposes of a Class 1 action, to prepare a joint report with Council’s expert planner, review draft conditions and attend the nominated court date for the Section 34 conciliation conference.
